Terms & Conditions
These terms govern your use of Qynko as a creator. By registering or using Qynko, you agree to them.
About These Terms
Qynko is operated by Procellence Technology, a sole proprietorship registered in West Bengal, India, whose proprietor is Mou Das Duya (GSTIN 19HKNPD4604R1ZF). In these Terms, "Qynko", "we" and "us" mean Procellence Technology, and "you" means the creator who registers and uses Qynko to sell.
By registering, accessing or using Qynko, you confirm that you are at least 18 years old, can enter into a binding contract under Indian law, and agree to these Terms together with our Privacy Policy, Cancellations & Refunds Policy and Account Deletion policy. If you do not agree, do not use Qynko.
You use Qynko to run a business. These Terms are a business-to-business agreement between you and Qynko.
- Buyer: Anyone who buys, books or joins one of your services through Qynko.
- Services: Everything you sell through Qynko, including 1:1 sessions, video courses, webinars and live events, paid communities, digital products and bundles of these.
- Storefront: Your public pages on Qynko, including your subdomain (for example, yourname.qynko.com).
What Qynko Offers
Qynko gives creators the tools to build a storefront and sell knowledge-based services:
- 1:1 Sessions: Private audio or video consultations that buyers book and pay for.
- Video Courses: Pre-recorded, self-paced courses hosted on Qynko, with optional live doubt-clearing sessions you schedule for your learners.
- Webinars & Live Events: Scheduled live sessions for a group of buyers.
- Paid Communities: Membership communities on Qynko, and communities you connect from Telegram. A community sold per period renews automatically for a buyer who turns on autopay.
- Digital Products: Files and resources that buyers download or open after purchase.
- Bundles: Several of your own services sold together as one purchase, either once for lasting access or for a period. A bundle sold per period renews automatically for a buyer who turns on autopay; otherwise the buyer renews by paying again.
- AI Features: An AI business assistant (Qynko Manager, included on every plan), AI generation of services, pages and policies, and market insights.
- Instagram Automation: Optional comment-to-DM automation for a connected Instagram Business or Creator account.
- Messaging: Email and WhatsApp messages to your buyers and contacts.
- Your Own Domain: An optional yearly add-on that serves your storefront on a domain you own and removes Qynko branding from what your buyers receive.
Role of Qynko
- Qynko is a technology platform and an intermediary under Section 79 of the Information Technology Act, 2000. We host your storefront and services; we do not create, select or modify the content you publish.
- You are the seller of every service you list. The contract for a service is between you and the buyer. You are responsible for delivering it as described.
- You appoint Qynko as your limited agent to collect payments from buyers on your behalf. When a buyer pays Qynko for your service, the buyer's payment obligation to you is fully discharged, even if the amount has not yet been paid out to you.
- Qynko pays out your earnings under these Terms after deducting commission, fees, refunds and any other amounts these Terms allow us to deduct.
- Qynko applies one platform refund policy to every purchase, as described in our Cancellations & Refunds Policy, and may decide refund requests that are escalated to us.
Creator Accounts and Eligibility
- You must be at least 18 years old. To receive payouts, you need an Indian bank account in your own name, and once your total earnings pass ₹5,000, a PAN and approved identity verification (KYC).
- You must give accurate, complete and current information and keep it up to date.
- You are responsible for keeping your login credentials confidential and for everything done through your account.
- You may not run more than one creator account without our prior written approval, and you may not use another person's identity, PAN or payout account.
- Your subdomain is granted on a non-exclusive, revocable basis and may be withdrawn if it infringes someone else's rights or misleads buyers.
Plans, Commission and Fees
Qynko charges a platform commission on every sale, based on your plan, plus GST on the commission. The commission and its GST are deducted from your earnings together; buyers are never charged them on top. Sales made before 23 October 2026 carry no GST on the commission. All amounts are in Indian Rupees (₹).
You can create coupons for your services, up to 100% off. A coupon cannot be edited or deleted after you create it; you can switch it off and on, up to 100 times, and a code that is switched off is refused at checkout. A coupon lowers the price the buyer pays, and you bear the whole discount. The platform commission, its GST and the payment gateway charge are calculated on the price after the discount. On a recurring bundle, or a community renewed with autopay, a coupon applies to the first payment only; renewals are charged the full price.
From 23 October 2026, every paid sale also carries a payment gateway charge of 2% of the price plus GST on that charge. By default it is deducted from your earnings. You may instead choose in Settings to add it to your buyers' checkout total, for all your services at once. A sale is settled on the choice in force when it was made, and sales made before 23 October 2026 carry none.
Plan prices, WhatsApp credit prices, the custom domain fee and the Managed Ads and Own App fees are exclusive of GST. GST is added at checkout when you buy or renew a paid plan, buy WhatsApp credits, buy or renew a custom domain, or pay for Managed Ads or Own App.
Every new account starts with a 14-day free trial. During the trial, the Free plan's commission of 8% applies to your sales.
A Qynko plan coupon takes up to 20% off your first billing period in place of the 6-month or yearly discount, never on top of it, and you pay whichever is lower. Renewals are at the plan's regular price for that billing period. A coupon made for you after a call with our team can be used only by you, once, within 7 days.
A change to a plan's price applies to new subscriptions. An existing subscription renews at the price it was bought at until you change your plan or billing cycle.
The Scale plan is for creators with high sales. Its price, billing period and commission are agreed with you on a call and sent to you in writing with a payment link that works for 7 days and only on your account. Scale includes everything in Business. Its commission applies to sales made after you pay, it renews at the agreed price, and it is otherwise billed like any other paid plan. When you pay for Scale, the autopay of your current plan stops and the unused part of it is not refunded.
If a renewal payment fails when a paid plan's period ends, you keep the plan for 7 more days; we tell you by email and in your dashboard, and the email gives the date your plan stays active until. A plan you pay for within those 7 days, whether the same plan or another one, counts from the day your previous period ended, so those days are part of the period you pay for. If the plan is still unpaid after them, your account moves to the Free plan; everything you created is kept, and the Free plan's limits apply. A plan bought after that starts on the day you pay. A plan you cancel or stop autopay on ends on its date without these 7 days, and we remind you by email and in your dashboard 7 days and 1 day before it ends. A downgrade to Free you choose also ends on its date without them.
Moving from one paid plan to a higher one applies at once, and you pay only the price difference for the days left in the period you have paid for. A downgrade applies at the end of that period; after a downgrade to Free, autopay stops and no other plan can be chosen until that period ends. You can cancel a paid plan at any time and keep it until the end of the period you paid for; the fee for that period is not refunded.
Buyers of a community or bundle sold per period can turn on autopay. Autopay charges each new period on the last day of the period already paid for, at the price and payment gateway charge in force when the buyer turned it on; a later price change applies to new buyers only. A buyer can cancel autopay at any time from My Purchases and keeps access to the end of the period they paid for; while autopay is on, the buyer cannot also renew by hand, and leaving a community cancels its autopay. If a renewal payment fails, the buyer keeps access for 3 days while it is retried. If you unpublish the bundle, or delete the community (a community cannot be unpublished), autopay stops at the end of the current period and nobody is charged again.

Custom Domain and Branding
On any plan, you can have your storefront served on a domain you own, such as yourbrand.com or academy.yourbrand.com. You can connect one domain to your account. While your domain is live, "Powered by Qynko" is removed from your buyers' emails, invoices, certificates and your expert card, and the "Made with Qynko" line is removed from your storefront footer. Qynko's legal and tax details stay on the invoices we issue, as the law requires. Your yourname.qynko.com address keeps working, and Qynko Studio stays on it.
- The fee is ₹16,999 per domain per year, exclusive of GST; GST is added at checkout and you receive a GST invoice. The paid year starts on the day your domain goes live.
- While your add-on is active, from payment until it lapses or is switched off, it includes AI Theme, generation included, for your storefront on any plan. On the Free plan without it, AI Theme is not available: your storefront uses the colours of the design palette you pick, or Qynko's standard colours where you pick My storefront theme; themes you already applied stay on any paid plan.
- Renewal is manual and nothing is charged automatically. We remind you 30, 7 and 1 days before the year ends, and you can renew from 30 days before it ends. A renewal extends the year from its end date, or from the day you renew if the year has already ended.
- If you do not renew, your domain keeps working for 7 days after the year ends and is then switched off. Your store keeps working on your Qynko address, and renewing switches your domain back on.
- If we cannot connect your domain, we refund the fee in full. Once your domain is live, the fee for that year is not refundable, and a renewal is not refundable once paid, unless the request was already closed or switched off by us when the payment arrived, in which case we refund it in full.
- You can change your domain up to 3 times in a paid year; the year carries over, and your previous domain stops serving your store when you switch.
- You own the domain: you register it, renew it with your domain provider, and add and keep the DNS records we give you. If your domain stops pointing to Qynko, we stop serving your storefront on it until the records are restored. We are not liable for downtime caused by your domain provider, your DNS settings or the domain lapsing with your provider.
- We may switch off a custom domain that infringes someone else's rights, impersonates another person or brand, or misleads buyers, under Suspension and Termination.
Managed Ads
Managed Ads is a monthly service in which our team runs ads for you, end to end, to bring new people to your Qynko storefront. You buy it in Qynko Studio under Billing, Add-ons, on any plan, and you agree to these terms when you tick the box and pay.
- What you get: We study your offer and audience, recommend the ad platforms that fit you best (such as Meta, which covers Facebook and Instagram, Google or Snapchat), build the funnel and the ads, choose whom to target and where, and improve the campaigns as they run. We also set up full tracking, including offline conversion tracking on the platforms that support it, which tells them which leads became paying customers so they can find more people like them.
- How results work: Every expert's audience, offer and strategy is different, so what works best is found by testing and improving month after month. We commit to doing that work with care and to showing you every number. Results are a shared effort: we bring you leads, and turning them into paying customers through your calls, demos, follow-ups, offer and price is in your hands. Because so much depends on factors outside our control, including each platform's systems, we do not guarantee a number of leads, sales, revenue or return on ad spend, and we are not responsible for how many leads become customers.
- You approve everything: Before anything goes live, we share the platforms, the budget split, the ad copy, the creatives and the audience with you, and ads run only after you approve them. Once you approve a plan, we improve it day to day without asking each time: shifting budget between approved campaigns within your total, adjusting audiences and bids, and pausing ads that underperform. A new platform, a new offer, new ad copy or creatives, or a higher total budget always needs your approval again.
- Your offer and your content: By approving an ad, you confirm that your offer and everything you give us or approve is true, that you have the rights to it (images, music, testimonials and the people shown), and that it follows the law and the ASCI Code, including the rules for your field, such as the CCPA Guidelines for Prevention of Misleading Advertisement in the Coaching Sector, 2024, rules on health and fitness claims, and SEBI rules for finance and investing content. We write ads that stay within the law and platform policies: no guaranteed outcomes, no false urgency or seat counts, and no claims that cannot be backed with proof. If an ad you want would break these rules, we tell you and suggest a change rather than run it.
- Your accounts and your data: Your ad accounts, pages and profiles, pixels or tags, and audiences on every platform stay in your name. You give our team partner access, and we never ask for your password or card. You can see your live spend and results in your own ad accounts at any time. Leads and data from your ads belong to you, and we use them only to run your ads. For offline conversion tracking, we send the ad platforms only hashed contact details of your own leads and buyers, and only for your campaigns, as set out in the Privacy Policy; for leads you collect outside Qynko, you confirm that you are allowed to share them. Within 7 days of the service ending, we remove our access and hand over everything we built in your accounts, and you can remove our access yourself at any time.
- Reports: Reports cover each platform, with spend, impressions, reach, clicks and the leads or sales the platform reports. You get at least one report a month. While campaigns are active, or after we change your setup (a new platform, budget split, campaign or audience), we report more often, weekly or twice a month, depending on the campaign.
- Price: ₹9,999 a month or 15% of the monthly ad budget you choose, whichever is higher, plus a one-time setup fee of ₹7,499 with your first payment. The setup fee covers setting up the ad accounts and tracking on every platform you approve, and is not charged again for another platform, for later months, or if you come back within 12 months of the end of your last paid month. If you come back after a longer gap, you start again as a new order and the setup fee applies. The setup fee is not charged if your accounts and tracking are already set up; we check this on the kickoff call.
- Paying month by month: Each payment covers one month of ads, from the day you pay or from the end of the month you already paid for. You can pay for the next month from Billing, Add-ons in the 5 days before your paid month ends, and we remind you before it does. Nothing is charged automatically: if you do not pay for the next month, we pause your ads when the paid month ends.
- Your ad budget: Your ad budget is your total across all platforms, and you approve how it is split between them. You pay it to each platform directly, from your own payment method, and each platform adds its own taxes. Qynko never holds your ad budget and adds no markup to it. We keep campaign budgets within the amount you chose, though each platform's own pacing can make daily spend vary. A platform's charges, refunds and billing disputes are between you and that platform.
- Fair use: Each month covers the campaigns and creatives your ads reasonably need, usually around 4 to 10 new creatives, including when you add a platform. Video shoots, influencer fees and pages outside Qynko are not included. If a request goes beyond this, we tell you before doing it.
- When a platform says no: Every ad platform reviews ads and can reject them or restrict an account on its own. When that happens, we help you appeal, adjust the ads and, if you agree, move your budget to another platform. We cannot overturn a platform's decisions, and we are not responsible for a platform's rejections, restrictions, policy changes, outages or reported numbers. If ads already ran in that month, our work for the month is done and its fee stands. If no ad has run yet that month, we hold your paid month for up to 60 days and restart it once your account is restored or your ads move to another platform you approve. If the block was caused by an ad we wrote that broke the platform's policy, we hold your month and fix the ads at no extra cost, and if no ad can run within those 60 days, we refund that month.
- Your creatives: Once paid for, the ads we make for you are yours to use. We do not reuse them for other experts, and we share your results publicly only with your permission. We may run ads for other experts, including ones in your field, but we never share your data, audiences, creatives or results with them. Our general methods, templates and know-how stay ours, and stock or licensed music, images and fonts in your ads are licensed for those ads only.
- Starting, pausing and stopping: Our team calls you within 1 business day of your first payment to start the work. You can stop at any time. We may pause your ads straight away if a payment is reversed, or if an ad or your account breaks the law, a platform's policies or these Terms.
- Liability: To the extent the law allows, our total liability for Managed Ads is limited to the Managed Ads fees you paid in the 3 months before the claim arose, and we are not liable for lost sales or profits or for anything an ad platform does. The Limitation of Liability and Indemnity sections also apply, including your indemnity for content you supplied or approved.
- GST and refunds: Prices exclude GST; GST is added at checkout and you receive a GST invoice by email. Once your GSTIN is approved, the invoice is issued to your business with that GSTIN, without you entering it again. A coupon shared by our team lowers the fee before GST is added. Refunds are set out in the Cancellations and Refunds Policy, under Qynko Plan Fees.
Own App
Own App is a service in which our team builds your branded app and publishes it on Google Play and the App Store in your name. You buy it in Qynko Studio under Billing, Add-ons, on any plan, and you agree to these terms when you tick the box and pay.
- Price: Own App costs ₹29,999, which covers building your app, publishing it and the first year of updates. From the second year, updates and store upkeep cost ₹9,999 a year, which you pay in Studio; nothing is charged automatically. If you do not renew, your app stays live and in your name, but we stop updating it for new Android and iOS versions, and we are not liable if Google or Apple remove an app that has not been updated. Renewing restores updates and, where needed, publishes the app again.
- Works on any plan: Your app keeps working on any Qynko plan, including Free. Changing or ending a paid plan changes only the fee on your sales, not the app. Your app shows your Qynko storefront, so it stops working only if your Qynko account is deleted, or suspended or terminated under these Terms.
- Your developer accounts: The Google Play and Apple developer accounts are in your name, and you pay their fees to Google and Apple directly.
- What you provide: Your business and identity details, legal documents, store listing content and access to your developer accounts, when we ask and kept accurate. The content in your app and your store listing are your responsibility.
- Store review: Our team calls you within 1 business day of your payment to start the work. Google and Apple decide whether to approve an app, and their review times are outside our control, so the 2 to 4 weeks we give is an estimate. If a store rejects your app, we fix what is needed on our side and resubmit, up to 3 times. If your app cannot be published because of something on our side, we refund the Own App fee in full. If the rejection comes from information, documents, content or developer account details you provide, or do not provide within 30 days of our request, there is no refund, and we still help you fix it and resubmit.
- Liability: To the extent the law allows, our total liability for Own App is limited to the Own App fees you paid in the 12 months before the claim arose. The Limitation of Liability and Indemnity sections also apply.
Earnings, Withdrawals and Payouts
- Your earnings from all services appear in your Payouts dashboard, after the commission and its GST.
- You can withdraw to an Indian bank account held in your own name. We do not pay to third-party accounts.
- Withdrawals are free: no fee is deducted from the amount you withdraw. The minimum withdrawal is ₹200.
- Withdrawals are processed by Qynko after review, typically within 2 working days. Banks and payment partners may take longer, and we are not responsible for their delays.
- Once your total earnings pass ₹5,000, you cannot withdraw until your identity verification (KYC) is approved. Withdrawals may be held as described under Payout Holds and Reviews.
- We may revise the minimum withdrawal amount with 14 days' notice.
Identity Verification (KYC)
Qynko collects buyer payments for you, so we must know who we pay. You can sign up, build your storefront, sell and withdraw without KYC until your total earnings pass ₹5,000. After that, you need approved KYC to withdraw, including earnings made before you passed that amount. A rejected KYC blocks withdrawals whatever you have earned.
- To complete KYC, you provide your legal name as on your PAN, your PAN, an image of your PAN card, a selfie holding your PAN card, and a payout account (bank account) in your own name, with an image of a cancelled cheque or a bank statement. You may also add business details such as your business name, GSTIN and a business proof document. A GSTIN must be registered to the PAN you give, and comes with the business address registered on it.
- If you send us a KYC document another way, such as by email, our team may upload it to your KYC record for you.
- We review KYC submissions within 2 working days. If we reject a submission, we tell you why and you can resubmit.
- We compare the name on your payout account with your PAN, and we may flag a PAN or payout account that is already used by another account.
- We may ask for further documents, or for a video verification call. We record a call only with your explicit consent; without it, we keep written notes of the call.
- Changing your payout account needs a one-time code sent to your registered mobile number, so we know you made the change; you can withdraw straight after. Once KYC applies to you, or while your KYC is under review, a new account must also be in your name as on your PAN: a new bank account needs an image of a cancelled cheque or a bank statement, and we check a new account before the first payout to it. If it is not in your name, we refund that withdrawal to your wallet and tell you why.
- Once KYC applies to you, it covers your whole balance, including earlier earnings. You must keep your KYC details accurate and tell us if they change.
Payout Holds and Reviews
We may hold or delay a payout, or stop withdrawals on your account, while we review it. We do this, for example, when:
- your KYC is rejected, or KYC applies to you and is pending, or a new payout account is being checked before its first payout;
- a sale is still within its refund window, or a refund, dispute or chargeback is open against your account;
- we see signs of fraud, collusion, fake purchases, misleading listings or a breach of these Terms;
- a bank, payment partner, law enforcement agency or court asks us to, or the law requires it; or
- you owe Qynko an amount under Recovery and Set-Off.
Refunds and Their Cost to You
- Every purchase is covered by Qynko's platform refund policy, set out in our Cancellations & Refunds Policy. If your own storefront policy differs, the platform policy applies. You may always refund a buyer as goodwill.
- The buyer always receives 100% of the amount they paid. Buyers are never charged for a refund.
- When a sale is refunded, your earnings from that sale are reversed and Qynko returns its commission and the GST on it to you. If you were already paid for the sale, those earnings are taken back from your balance; if you were not yet paid, as with a webinar or 1:1 session before it is held, no earnings are taken back and the sale is not paid out, though the processing charge below still applies.
- You bear the payment processing charge on every refund. The processing charge is the payment gateway charge on that sale: if you paid it out of your earnings, it is not returned to you; if the buyer paid it at checkout, the buyer gets it back and the same amount is taken from your balance. A sale made before 23 October 2026 carries none. The buyer is never charged for a refund. Qynko bears the charge only when a payment is returned because the purchase could not be completed.
- You are paid for the 1:1 sessions you hold, after the hold described under Payout Holds and Reviews. A recurring webinar series is paid out once, after its last session, so sales made while it runs are paid with the rest. Refunds are never made automatically. To cancel a paid 1:1 session or webinar you use Cancel and refund, which refunds every buyer in full at once, unless they booked it through a bundle, and you earn nothing for that booking. If you do not join a 1:1 session or webinar, the buyer is not refunded automatically: they can raise a refund request, and you refund it from that ticket. For a 1:1 session you can also refund the booking yourself from its page in Bookings, without waiting for a request. Refund requests from buyers reach you as support tickets; you decide them under the platform policy, and buyers can escalate unresolved requests to Qynko. If you have not responded to a refund ticket within 3 days you are reminded, and after 7 days without a response it passes to Qynko support, which may decide it.
- If you remove a course, product or community that buyers have paid for on its own, and their paid access is still running, you may have to restore their access or refund them for the access they lose. Such refunds are deducted from your balance like any other refund. Removing a service from a bundle stops buyers opening, claiming, booking or joining it through that bundle; anything they already claimed, booked or joined through it is not taken back, the rest of the bundle keeps working, and no refund is due for the removed service.
- A refund you approve or make on an order, or Qynko support approves on an escalated request, is issued once your balance covers what it takes from you; until then the request stays open. While a buyer's refund request is open, the money it would take from you cannot be withdrawn.
Recovery and Set-Off
- You owe Qynko any amount we pay or bear because of your sales, including refunds, chargebacks, payment disputes, fraud losses, payment processing charges on refunds, chargebacks and disputes, fees, taxes and penalties imposed because of your services.
- We may recover these amounts from your pending or available balance, and from your future earnings, before paying you out.
- Your balance never goes below zero. When a refund made because you cancelled a paid session or event costs more than your balance holds, the rest is a debt you owe to Qynko: it is taken from your next earnings before you can withdraw them.
- If an amount you owe is not cleared within 60 days, we may restrict your account and recover it by any lawful means, including legal proceedings.
- These rights continue after your account is closed.
Taxes
- You are responsible for your own taxes, including registering for GST where required, charging and paying GST on your services, and filing your returns.
- Qynko may deduct tax at source (TDS) under Section 194-O of the Income-tax Act, 1961 and collect tax at source (TCS) under Section 52 of the CGST Act, 2017 from your payouts where the law requires, and may recover from you any tax it has to pay on your sales.
- Once KYC applies to you, you must give us a valid PAN. Without a valid PAN on file, tax may be deducted at a higher rate as the law requires.
- Plan fees are shown excluding GST. GST is added at checkout and shown on your plan's tax invoice.
- Each month Qynko issues you a GST tax invoice for the commission and payment gateway charges on your sales that month. Once your GSTIN is approved, these invoices and every Qynko purchase invoice carry it, so you can claim the GST as input tax credit. You can give a GSTIN with your KYC, or add or change it from the Payouts page after your identity is verified; either way Qynko checks it on the GST portal before approving it, and your withdrawals are not affected while it is checked. Credit applies to invoices from the approval onward; invoices issued before it are not reissued. If you remove your GSTIN, invoices from that moment on are issued to you without it, and earlier invoices do not change.
Accurate Listings
Every listing on your storefront must be true and not misleading:
- The title, description, duration, number of lessons or sessions, content, price and delivery method must match what the buyer actually receives.
- You can edit a published course at any time, including after it has sold. Lessons you add or change reach existing buyers automatically, lessons you remove stop being available to them, and a lesson you keep as a draft stays hidden from buyers and your storefront until you publish it. A new price applies only to new buyers. Removing content does not release you from delivering what your listing promised when the buyer paid.
- You can unpublish a course, webinar, 1:1 session, product or bundle at any time, including after it has sold, unless it is included in a published bundle or in a bundle that a buyer still has access to. An unpublished or draft listing is hidden from your storefront and its direct link, including when you view your own storefront, and it can no longer be bought. Buyers who already paid keep access to what they bought. A course with enrolments, a webinar with registrations, a product that has sold and a 1:1 session that has a paid booking can be unpublished but not deleted; a webinar can still be cancelled, which refunds its attendees.
- Do not make claims about results, income or outcomes that you cannot support.
- On a designed landing page or your designed store home page, the testimonials, screenshots, reviews, numbers, credentials, "featured in" names and bonuses you add must be genuine, and you must be able to show where each came from. The countdown, seats left and recent bookings are generated by Qynko from your real schedule and sales and cannot be edited.
- If you offer a certificate, state who issues it. Do not claim that a certificate is accredited, official or recognised by a body unless it is, and do not suggest any affiliation with a certification body, university, government agency or brand that you do not have.
- You must own, or have permission to use, every image you upload, including written consent from anyone who can be identified in it, such as customers in a testimonial photo.
- We may ask for proof of any claim. We may edit, hide or remove a listing that we find inaccurate, and refund its buyers.
Prohibited Services
You must not sell, promote or offer through Qynko:
- investment, securities or trading advice, tips, calls or research that require registration with SEBI (for example, as an investment adviser or research analyst) unless you hold that registration and display it;
- gambling, betting, lottery or fantasy games, or tips for them;
- multi-level marketing, pyramid or chain schemes, "task" jobs, "earn money online" schemes, or anything that promises guaranteed income;
- loans, credit, debt settlement or other regulated financial products;
- medical diagnosis, treatment or cure claims, or prescription of medicines, unless you are a qualified and registered practitioner acting within the law;
- adult, sexually explicit or obscene content;
- weapons, drugs, controlled substances or other illegal goods or services;
- content that infringes anyone's copyright, trademark or other rights, including resold or pirated courses;
- certifications or qualifications that are misleading, or that claim an affiliation with a certification body you do not have; or
- anything else that is illegal in India or that we reasonably consider harmful to buyers.
Prohibited Conduct
You must not:
- upload or share content that is illegal, obscene, defamatory, hateful or harassing, or that violates the IT Rules, 2021;
- impersonate another person or business, or misrepresent your identity, qualifications or affiliations;
- buy your own services, or arrange purchases by people connected to you, to test payouts, inflate sales or move money;
- manipulate reviews, ratings, sales counts or enrolment figures;
- take payment from buyers outside Qynko for services found through Qynko, or otherwise avoid commission;
- use Qynko for fraud, phishing, money laundering or any illegal scheme;
- send spam, or message people who have opted out;
- use the Instagram Automation feature in breach of Meta's Platform Terms or the Instagram Community Guidelines; or
- reverse-engineer, scrape, overload or disrupt Qynko.
Buyer Data and Communications
- When a buyer purchases from you, their name, email address, phone number and purchase details are added to your contacts on Qynko.
- You may use buyer data only to deliver your services, to support your buyers and to send them updates and marketing about your own services.
- People who download one of your free resources (lead magnets) are added to your contacts on the same terms as buyers. Contacts collected beyond your plan's contact limit are stored but locked: you cannot see or message them until your plan covers them.
- Every marketing message must let the recipient opt out, and you must stop marketing to anyone who opts out or asks you to stop.
- You must not sell buyer data, share it with third parties for their marketing, or use it for any unlawful purpose. Hashed contact details that Qynko shares with the ad platforms you approve for your own Managed Ads campaigns are not a breach of this rule.
- For your own use of buyer data, you are responsible for complying with the Digital Personal Data Protection Act, 2023 and other applicable law. If you export buyer data outside Qynko, you are responsible for it.
Content and Intellectual Property
- You keep ownership of all content you upload to Qynko.
- You grant Qynko a non-exclusive, royalty-free, worldwide licence to host, store, copy, display, transcode and deliver your content, only to operate Qynko, deliver your services and promote your storefront on Qynko.
- You confirm that you own your content or have the rights needed to sell it, and that it complies with Indian law.
- If you share something through a link, for example a lead magnet that opens a Google Drive, Dropbox or Notion page, you are responsible for what it contains, for having the rights to share it, for its compliance with Indian law and for keeping the link working. Qynko does not host or check it, and we may disable the link under Notice and Takedown.
- Qynko, its software, design and brand belong to Procellence Technology. You may not copy or use them except as these Terms allow.
Notice and Takedown
- Anyone can report content on Qynko that they believe is unlawful, infringes their rights or breaches these Terms, by writing to grievance@qynko.com with a link to the content and the reason.
- Copyright owners may send a written notice under Section 52(1)(c) of the Copyright Act, 1957. We will disable access to the content as that section requires, and restore it if the complainant does not produce a court order within the period the law allows.
- We act on complaints and on orders from courts or government agencies within the timelines set by the IT Rules, 2021. We may remove or disable content, suspend a listing and hold related payouts while we act.
- If we remove your content, we tell you why, and you can respond or ask us to reconsider through the Grievance Officer.
AI Features
Qynko's AI features (including Qynko Manager and AI generation of services, pages and policies) use third-party AI providers. AI output can be wrong, incomplete or unsuitable. You are responsible for reviewing anything AI generates before you publish or rely on it.
Market insights are for information only. They are not financial, business or investment advice, and results are not guaranteed.
Instagram Automation
Qynko offers an optional Instagram Automation feature that auto-replies to comments and sends direct messages from your connected Instagram Business or Creator account when commenters use keywords you define. If you use it:
- Connect only an Instagram account that you own or are authorised to manage. You are responsible for the posts, keywords and messages you configure.
- Your use must comply with Meta's Platform Terms, the Instagram Community Guidelines and all Meta and Instagram policies. Do not send spam or unsolicited, deceptive or prohibited content.
- You must honour opt-outs: Qynko stops messaging a commenter who replies STOP, and you must not work around this. Where a law that applies to you or your audience requires automated messages to say they are automated, you are responsible for adding that to your messages.
- If you add follow-up messages, Qynko sends them only within 24 hours of the commenter's last message or tap, as Meta's messaging rules require, and skips any that would arrive later. A follow-up may recommend only one of your own published paid services.
- Qynko provides the tool only. We are not liable for any action Meta takes against your account, including rate limits, restrictions, suspension or bans.
- You can disconnect Instagram at any time from Settings → Integrations → Instagram, which clears your stored access token and stops all automations.
- Instagram and the Instagram API are products of Meta Platforms, Inc. Qynko is not endorsed by, sponsored by or affiliated with Meta.
Third-Party Services
Some features rely on third-party services, such as Razorpay for payments, Telegram for communities, WhatsApp for messages, and Google Meet, Google Calendar, MeetHour and Agora for sessions. Your use of those services is also subject to their own terms. We are not responsible for outages or changes on their side.
Suspension and Termination
- You may close your account at any time, as described in our Account Deletion policy.
- We may suspend or restrict your account, remove listings or hold payouts, with or without notice, if you breach these Terms, if we suspect fraud or misuse, or if the law or a lawful order requires it. Where possible, we tell you the reason.
- When your account closes, any available balance, after holds, refunds and recoveries, is paid to your verified payout account within 30 days after all holds, refund windows and disputes on your sales have closed, provided your KYC is approved where it is required.
- Buyers' refund rights for purchases made before closure continue under our Cancellations & Refunds Policy.
Disclaimer of Warranties
Qynko is provided on an "as is" and "as available" basis. We do not guarantee earnings, uninterrupted availability, or that Qynko will meet your particular needs.
Limitation of Liability
To the extent permitted by law, Qynko's total liability to you for any claim is limited to the plan fees and commission you paid to Qynko in the 3 months before the claim arose. Qynko is not liable for indirect, incidental or consequential losses, such as lost profits, lost data or loss of goodwill. This limit does not apply to our obligation to pay you the earnings we collect on your behalf, less the amounts these Terms allow us to deduct.
Nothing in these Terms limits liability that cannot be limited by law, or your obligation to pay amounts you owe to Qynko.
Indemnity
You will indemnify and hold harmless Qynko, Procellence Technology, its proprietor, staff and partners against any claim, loss, penalty, tax, refund, chargeback or cost (including reasonable legal fees) arising from your services, your content, your listings, your use of buyer data, your breach of these Terms, or your breach of any law or third-party right.
Governing Law, Disputes and Arbitration
- These Terms are governed by the laws of India.
- Please contact support@qynko.com first; most issues can be resolved quickly.
- Any dispute between you and Qynko arising out of or relating to these Terms that is not resolved within 30 days will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat of arbitration is Kolkata, and the proceedings will be in English.
- The courts at Kolkata have exclusive jurisdiction over matters in aid of the arbitration, including appointing the arbitrator, interim relief and any challenge to the award. For any matter that is not referred to arbitration, the courts of Tamluk, West Bengal have exclusive jurisdiction.
